Is My Window Tint Legal?
Generally, it is not legal to add window tint or other sun screening devices to your motor vehicle. The exact guidelines can be found in the PA Vehicle Code (Title 75) under Section 4524 - Windshield Obstructions and Wipers. Within that section is subsection (e) titled Sun Screening and Other Materials Prohibited. The subsection reads: (1) No person shall drive any motor vehicle with any sun screening device or other material which does not permit a person to see or view the inside of the vehicle through the windshield, side wing or side window of the vehicle.
What About Factory Tint?
Subsection (2)(i) provides an exception for factory tint and reads: A vehicle which is equipped with tinted windows of the type and specification that were installed by the manufacturer of the vehicle or to any hearse, ambulance, government vehicle or any other vehicle for which a currently valid certificate of exemption has been issued in accordance with regulations adopted by the department (PennDOT).
What this basically means is that this law does not apply to manufacturer applied tint or tint applied to factory specifications (for example, a vehicle repaired by a body shop to factory specifications).
What About Medical Conditions?
Subsection (3)(ii) states that a certificate of exemption shall be issued by PennDOT for any physical condition requiring sun screening devices. Any person requesting this exemption must have the physical condition certified to PennDOT by a licensed physician or optometrist. It should be noted that the certificate must be carried in the vehicle and displayed if requested by a police officer. Also, the exemption is null and void if the vehicle is sold to an individual without the exemption and the tint must be removed.
